Terms of Service

Welcome to Octera. These Terms of Service (the "Terms") are a binding legal agreement between you and Octera ("Octera," "we," "us," or "our") that governs your access to and use of the Octera Discord bot, the Octera web dashboard at https://dash.octera.xyz, the marketing website at https://octera.xyz, and all related features, modules, and services we provide (together, the "Service"). Octera is operated by itsJmikee LLC, a single-member limited liability company registered in Missouri, USA. Please read these Terms carefully. They include important provisions that limit our liability and require you to resolve disputes in a specific way.
By adding the Octera bot to a Discord server, signing in to the dashboard, purchasing a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of These Terms
These Terms apply to everyone who uses the Service, including the person who adds the bot to a server ("server administrators"), members of servers where the bot is present, and anyone who visits our website or signs in to the dashboard. By using the Service in any of these ways, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.
If you use the Service on behalf of a Discord server, organization, or other group, you represent that you have the authority to bind that group to these Terms, and "you" includes both you and that group.
2. Eligibility
To use the Service, you must:
- Be at least 13 years old, or the minimum age of digital consent in your country if that age is higher;
- Have the legal capacity to enter into a binding contract; and
- Comply at all times with the Discord Terms of Service and the Discord Community Guidelines.
The Service relies on Discord and is offered only to people who are eligible to use Discord. If you do not meet these requirements, you may not use the Service. We may suspend or terminate access for any account or server we reasonably believe does not meet these eligibility requirements.
3. Description of the Service
Octera is a multi-purpose Discord bot and accompanying web dashboard that gives server administrators tools to run and grow their communities. Depending on your configuration, the Service may include modules for:
- Moderation — warnings, mutes, kicks, bans, message management, and case logging;
- Anti-nuke security — protections against mass actions, unauthorized administrative changes, and abuse;
- Economy — virtual currency, balances, and related in-server activities;
- Leveling — experience points, ranks, and rewards;
- Tickets — support-ticket creation and management;
- Automation and custom commands — triggers, responses, and configurable workflows;
- Music — audio playback in voice channels;
- AI moderation — optional automated content review powered by a third-party AI provider;
- Reaction roles — self-assignable roles;
- Social notifications — alerts about activity on supported external platforms.
The Service is provided as an ongoing online service, not a one-time product. We may add, change, or remove features, modules, and functionality at any time. The features available to you may depend on whether you have a free or premium subscription.
4. Signing In With Discord
The dashboard uses Discord OAuth to let you sign in with your Discord account. When you sign in, you authorize us to receive certain information from Discord, such as your Discord account identifier, username, avatar, and the servers you can manage, in accordance with the permissions you grant and our Privacy Policy. You are responsible for keeping your Discord account secure. We are not responsible for any activity that occurs through your Discord account, and you should review Discord's own terms and privacy practices, which govern your Discord account independently of these Terms.
5. Acceptable Use and Prohibited Conduct
You agree to use the Service lawfully, responsibly, and in a way that respects other users. You must not, and must not allow or encourage anyone else to:
- Use the Service to violate any applicable law or regulation, or to facilitate any illegal activity;
- Violate the Discord Terms of Service, Discord Community Guidelines, or the terms of any other third-party service used with the Service;
- Use the Service to harass, abuse, threaten, defame, stalk, or harm others, or to distribute hateful, violent, or sexually exploitative content;
- Use the Service to send spam, run unauthorized advertising, or distribute malware or other harmful code;
- Attempt to gain unauthorized access to the Service, other users' accounts, our systems, or any data you are not authorized to access;
- Probe, scan, overload, disrupt, or interfere with the Service or its underlying infrastructure, including through denial-of-service attacks, excessive automated requests, or attempts to circumvent rate limits;
- Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the limited extent that applicable law expressly permits;
- Resell, sublicense, or commercially exploit the Service without our prior written permission;
- Abuse, manipulate, or exploit any module, including the economy, leveling, or premium features, in a way they are not intended to be used; or
- Use the Service to collect or store personal information about others in violation of applicable privacy laws or the rights of those individuals.
As a server administrator, you are responsible for how the Service is configured and used in your server, including ensuring that your use of moderation, automation, AI moderation, and data-collection features complies with applicable law and that your members are appropriately informed where required. We may investigate suspected violations and take any action we consider appropriate, including removing content, restricting features, or terminating access.
6. Premium Subscriptions, Billing, and Payments
6.1 Premium Plans and Pricing
Octera offers an optional premium subscription that unlocks additional features. Premium is sold on a per-server basis at US $4.99 per month per server (or US $49.99 per year per server). We may change pricing or the features included in premium from time to time; any price change will apply to future billing periods, and where required we will give you reasonable notice.
6.2 Billing through Patreon
Premium memberships are offered and processed through Patreon. This means Patreon, not Octera, handles billing, payment processing, and the calculation and collection of applicable taxes. Your purchase is also subject to Patreon's own terms and policies. We do not receive or store your full payment card details.
6.3 Auto-Renewal
Premium subscriptions renew automatically. Unless you cancel before the end of the current billing period, your subscription will automatically renew for another period of the same length, and the applicable fee will be charged through Patreon using your selected payment method. By purchasing a subscription, you authorize these recurring charges until you cancel.
6.4 Cancellation
You may cancel your premium subscription at any time. When you cancel, your subscription will remain active until the end of the current billing period, and it will not renew after that. Cancellation stops future charges; it does not, by itself, entitle you to a refund for the current period. If you need help cancelling, join our Discord support server.
6.5 Refunds
Except where a refund is required by applicable law, premium fees are non-refundable, and partial billing periods are not refunded or prorated. Any refund that is granted is processed through Patreon and is subject to Patreon's policies. To request a refund or raise a billing issue, join our Discord support server.
6.6 Failed Payments and Downgrades
If a renewal payment fails or a subscription lapses, we may suspend or remove premium features for the affected server until payment is resolved. Data tied to premium-only features may become inaccessible while premium is inactive.
7. User Content and License to Us
"User Content" means any content, data, settings, configurations, messages, custom commands, or other material that you or your server members submit to, create with, or process through the Service. As between you and us, you (or your server, as applicable) retain ownership of your User Content.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, display, and otherwise use your User Content solely as necessary to operate, maintain, secure, and improve the Service and to provide the features you have enabled. This includes processing content through our subprocessors, such as sending content to an AI provider when you enable AI moderation. You represent and warrant that you have all rights necessary to submit your User Content and to grant this license, and that your User Content does not violate these Terms, any law, or the rights of any third party.
You are solely responsible for your User Content and for backing up anything important to you. We are not obligated to store or retain User Content and may delete it in accordance with our data-retention practices described in Section 14.
8. Intellectual Property
The Service, including the Octera name, logo, branding, software, code, design, text, graphics, and all related intellectual property, is owned by Octera or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership of the Service to you.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works of the Service or our branding except as expressly permitted by these Terms or by applicable law. All rights not expressly granted to you are reserved by us.
If you believe that content available through the Service infringes your copyright, you may send a notice to our designated agent by joining our Discord support server. Your notice should identify the copyrighted work, identify the allegedly infringing material with enough detail for us to locate it, provide your contact information, include a statement that you have a good-faith belief that the use is not authorized, and include a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf. We will respond to valid notices as required by applicable law and may remove infringing material and terminate repeat infringers. If you believe material was removed in error, you may submit a counter-notification through the same support server.
9. Third-Party Services and Discord
The Service depends on and interoperates with third-party services that we do not control, including Discord, our infrastructure and payment providers, and the platforms supported by our social-notification features. Your use of those third-party services is governed by their own terms and privacy policies, and we are not responsible for their availability, accuracy, content, or practices.
Octera is an independent project and is not affiliated with, endorsed by, or sponsored by Discord Inc. "Discord" and related marks belong to Discord Inc. If Discord changes, restricts, or discontinues its platform, APIs, or policies, the Service may be affected, and we are not responsible for any resulting disruption.
To operate the Service, we use the following subprocessors and infrastructure providers: Render (application hosting and PostgreSQL database), Cloudflare (marketing site and content delivery), Patreon (membership billing and payment processing), and Anthropic (optional AI moderation). We do not sell personal data. Our use of these providers and how we handle your information are described further in our Privacy Policy.
10. Disclaimers
The Service is provided "as is" and "as available," with all faults and without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of harmful components, that any defects will be corrected, or that the Service will meet your requirements or expectations. Automated features, including AI moderation and anti-nuke security, are tools that may produce false positives or false negatives; they are not a substitute for human judgment, and you remain responsible for moderation and security decisions in your server. You use the Service at your own risk and are responsible for maintaining your own backups of important data.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
11. Limitation of Liability
To the fullest extent permitted by law, Octera and its developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.
Our total cumulative liability for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) US $100.
These limitations apply to all claims, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and they reflect a reasonable allocation of risk that is an essential basis of the bargain between you and us. Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above limitations may not apply to you; in that case, our liability is limited to the smallest amount permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Octera and its developer from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the Service; (b) your User Content; (c) your violation of these Terms or any applicable law; (d) your violation of the rights of any third party, including Discord or your server members; or (e) the way you configure or operate the Service in any server you administer. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
13. Suspension and Termination
You may stop using the Service at any time by removing the bot from your server and discontinuing use of the dashboard. We may suspend, restrict, or terminate your access to all or part of the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if your use poses a risk to the Service or others, if required by law or by a third-party provider such as Discord, or if we discontinue the Service.
Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination, including those on user content licenses, intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will continue to apply. Termination does not entitle you to a refund except where required by law.
14. Data Retention and Deletion
We retain data associated with a server while the Octera bot is present in that server. After the bot is removed from a server, or upon a verified deletion request, we delete the associated stored data within approximately thirty (30) days, except where we are required or permitted by law to retain it for longer. To make a data-deletion or privacy request, join our Discord support server. Additional detail about what we collect and how we handle it is provided in our Privacy Policy.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where appropriate, provide additional notice. Changes take effect when posted unless we state otherwise. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Missouri, and you consent to the personal jurisdiction of those courts and waive any objection to venue in those courts. Nothing in this section limits any non-waivable rights you may have under the mandatory laws of your country of residence.
17. Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms in connection with a transfer of the Service. These Terms, together with our Privacy Policy and any additional terms that apply to specific features, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings on that subject.
18. How to Contact Us
The only way to reach us, for support, legal notices, copyright and DMCA matters (including notices to our designated agent and counter-notifications), privacy and data-deletion requests, billing questions, and any other notice, is to join our Discord support server. We do not provide a contact method other than the support server.
