This Privacy Policy explains how Octera ("Octera," "we," "us," or "our") collects, uses, shares, and protects information when you use the Octera Discord bot, our marketing site at https://octera.xyz, and our web dashboard at https://dash.octera.xyz (together, the "Service"). Octera is operated by itsJmikee LLC, a single-member limited liability company registered in Missouri, USA. We are committed to handling your information responsibly and to collecting only what we need to operate the Service.
By adding the Octera bot to a Discord server, signing in through Discord, or otherwise using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with it, please do not use the Service.
Octera is an independent project and is not affiliated with, endorsed by, or sponsored by Discord Inc.
1. Who This Policy Applies To
This policy applies to two main groups of people:
- Server administrators and members of servers where the bot is installed. The Octera bot processes information about the Discord servers it has been added to and the members who interact with it.
- Dashboard users. People who sign in to our web dashboard with Discord OAuth to configure the bot, manage their servers, or purchase a premium subscription.
If you are a server administrator who installs Octera, you are responsible for telling the members of your server that Octera is in use and for ensuring you have any consent or notices required by the laws that apply to you and your community.
2. Information We Collect
2.1 Information from Discord
When you sign in to our dashboard with Discord OAuth, or when you interact with the bot, we receive information that Discord provides, which may include:
- Your Discord user ID, username, global display name, and avatar.
- The list of Discord servers you own or manage (so we can show you which servers you can configure).
- Your roles, permissions, and membership status within a given server, as needed to enforce permissions and run features.
2.2 Server and configuration data
To provide the bot's features, we store data tied to the servers where Octera is installed, which may include:
- Server IDs, channel IDs, role IDs, and per-server configuration settings (for example, which modules are enabled and how they are set up).
- Moderation and security data such as moderation cases, warnings, infractions, mutes, bans, and anti-nuke security logs.
- Economy and leveling data such as virtual currency balances, inventory, experience points (XP), and rank information.
- Tickets data such as ticket records, transcripts, and related metadata.
- Automation data such as custom commands, triggers, scheduled actions, and reaction-role configurations.
- Social notification subscriptions such as the external accounts or channels (for example, YouTube, TikTok, Twitch, or Kick) a server has chosen to follow, along with the destination channels for those notifications.
2.3 Limited message content
Octera does not store the general contents of your conversations. We process limited message content only where a feature you have enabled requires it, specifically:
- Automated moderation, where message text is checked against the rules and filters a server has configured (for example, banned words, spam, or link filtering).
- AI moderation, where message text may be analyzed to detect content such as harassment, threats, or other policy violations.
Message content processed for these purposes is used to perform the moderation action and to create the related moderation record, and is not retained beyond what is needed for those purposes.
2.4 Payment information
If you purchase a premium membership, payment is handled by Patreon. We do not collect or store your full payment card details. We receive limited transaction and membership information from Patreon (such as the fact that a patron has an active pledge and related billing status) so we can enable premium features.
2.5 Cookies and session data
Our dashboard uses cookies and similar technologies that are necessary to operate the site, including session cookies that keep you signed in after you authenticate with Discord and cookies that help keep the Service secure. These are essential cookies required for the dashboard to function.
2.6 Technical and log data
Like most online services, our systems automatically record certain technical information when you use the Service, which may include your IP address, browser type, device and operating system information, pages or endpoints accessed, timestamps, and diagnostic or error logs. We use this information to operate, secure, debug, and improve the Service.
3. How and Why We Use Information
We use the information described above to:
- Provide, operate, and maintain the bot and dashboard and their features.
- Authenticate you and remember your session.
- Apply your per-server configuration and run the modules you have enabled (moderation, anti-nuke security, economy, leveling, tickets, automation and custom commands, music, AI moderation, reaction roles, and social notifications).
- Enforce permissions so that only authorized people can use certain commands or change settings.
- Process premium subscriptions and enable premium features.
- Detect, prevent, and respond to abuse, spam, security threats, and violations of our terms or a server's rules.
- Diagnose problems, monitor performance, and improve the Service.
- Communicate with you about support requests and important changes to the Service.
- Comply with our legal obligations and enforce our agreements.
4. Legal Bases for Processing
Where the General Data Protection Regulation (GDPR) or similar laws apply, we rely on the following legal bases to process personal data:
- Performance of a contract — to provide the Service you or your server has chosen to use, including premium subscriptions.
- Legitimate interests — to operate, secure, and improve the Service, prevent abuse, and keep our systems reliable, where those interests are not overridden by your rights.
- Consent — where required, for example when a server enables optional features that process additional data; you may withdraw consent at any time.
- Legal obligation — where we must process information to comply with applicable law.
5. How We Share Information
We do not sell your personal data. We do not share your personal information with third parties for their own advertising or marketing. We share information only in the limited circumstances described below.
5.1 Service providers and subprocessors
We use a small number of trusted providers to run the Service. They process information only on our behalf and only as needed to provide their services:
- Render — application hosting and our PostgreSQL database, where the Service runs and stored data is kept.
- Cloudflare — hosting and content delivery (CDN) for our marketing site, and related security and performance features.
- Patreon — membership billing and payment processing, including handling of payment data and applicable taxes.
- Anthropic — optional AI moderation. When AI moderation is enabled for a server, relevant message text may be sent to Anthropic to be analyzed. If AI moderation is not enabled, no message content is sent to Anthropic.
5.2 Legal and safety
We may disclose information if we believe in good faith that doing so is necessary to comply with a law, regulation, legal process, or enforceable governmental request; to enforce our terms; to detect, prevent, or address fraud, security, or technical issues; or to protect the rights, property, or safety of Octera, our users, or the public.
5.3 Within Discord servers
Some features are designed to display information inside Discord by their nature — for example, leveling rank cards, economy leaderboards, or moderation logs posted to a channel. This information is visible to people in the relevant server according to the server's settings and Discord's own permissions.
6. Data Retention
We keep stored data for as long as the bot remains in a server and the data is needed to provide the Service. After the bot is removed from a server, or after we receive and verify a deletion request, the associated data is deleted within approximately 30 days, except where we are required to retain certain records to comply with legal obligations or to resolve disputes. Limited technical logs may be retained for a short period for security and diagnostic purposes and are then deleted or anonymized.
7. Security
We use commercially reasonable administrative, technical, and organizational measures to protect information against loss, theft, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You use the Service at your own risk and are responsible for keeping your own Discord account and credentials secure.
8. Your Rights and Choices
Depending on where you live, you may have some or all of the following rights regarding your personal information:
- Access — request a copy of the personal data we hold about you.
- Correction — ask us to correct inaccurate or incomplete data.
- Deletion — ask us to delete your personal data.
- Portability / export — request an export of certain data in a portable format.
- Objection and restriction — object to or ask us to restrict certain processing.
- Withdraw consent — where we rely on consent, withdraw it at any time (this does not affect processing already carried out).
To exercise any of these rights, join our Discord support server and contact us there. We may need to verify your identity, for example by confirming control of the relevant Discord account, before acting on a request. We will respond within the timeframe required by applicable law.
8.1 GDPR (European Economic Area, UK, and similar)
If you are in a region covered by the GDPR or comparable laws, you have the rights described above and the right to lodge a complaint with your local data protection authority. We process your data on the legal bases set out in Section 4.
8.2 California (CCPA/CPRA)
If you are a California resident, you have the right to know what personal information we collect and how we use and share it, the right to request access to and deletion of your personal information, the right to correct inaccurate information, and the right not to be discriminated against for exercising your rights. We do not sell or share your personal information as those terms are defined under California law. To exercise your rights, contact us through our Discord support server.
9. How to Delete Your Data
You can have your data deleted in either of these ways:
- Remove the bot. A server administrator can remove (kick) Octera from a server. The data associated with that server is then deleted within approximately 30 days.
- Request deletion. Join our Discord support server and ask us to delete your data. Once we verify the request, the associated data is deleted within approximately 30 days.
10. Children's Privacy
The Service is not directed to children, and you may not use it unless you are at least 13 years old (and at least the minimum age of digital consent in your country, whichever is higher) and are able to comply with the Discord Terms of Service. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us through our Discord support server so we can delete it.
11. International Data Transfers
Octera and its providers are based in or operate from the United States and may process and store information in the United States and other countries. If you access the Service from outside the United States, you understand that your information may be transferred to, stored in, and processed in countries whose data protection laws may differ from those in your country. Where required, we take steps to ensure such transfers are subject to appropriate safeguards.
12. Third-Party Services and Links
The Service relies on and may link to third-party services, including Discord and the providers listed in Section 5, as well as external accounts referenced by social notification features. We are not responsible for the privacy practices or content of those third parties. We encourage you to review their privacy policies, including Discord's, to understand how they handle your information.
13. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any data will be preserved without loss. You use the Service at your own risk to the fullest extent permitted by law.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Octera and its developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
15. Indemnification
You agree to indemnify, defend, and hold harmless Octera and its developer from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your violation of this Privacy Policy or applicable law, or your violation of the rights of any third party, including in connection with content or configurations you create or manage through the Service.
16. Premium Subscriptions
Octera offers an optional premium membership from US $4.99 per month depending on the tier you choose (US $4.99, $9.99, or $14.99 for premium on 1, 2, or 3 servers), with annual pricing where available, billed through Patreon, which handles billing, payment processing, and applicable taxes. Memberships automatically renew until cancelled. You can manage or cancel a subscription as described at checkout or by contacting us through our Discord support server. Patreon's handling of your payment information is governed by Patreon's own privacy policy.
17. Governing Law and Disputes
This Privacy Policy and any dispute arising out of or relating to it or the Service are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-laws rules. You agree that any dispute will be brought exclusively in the state and federal courts located in Missouri, and you consent to the personal jurisdiction and venue of those courts.
18. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page, and significant changes may also be announced through the Service or our Discord support server. Your continued use of the Service after changes take effect means you accept the updated policy. We encourage you to review this page periodically.
